Gifty Amoakowaa, a Ghanaian lady, has filed a lawsuit against Peace and Love Hospital, claiming that the facility infringed her constitutional rights by installing security cameras in rooms used for private medical evaluations, such as breast exams.
According to the lawsuit, which was submitted to the High Court, the installation of closed-circuit television (CCTV) equipment in such delicate areas is a flagrant violation of her right to privacy, dignity, and the secrecy that is expected during medical encounters.
She is requesting that her basic human rights under Ghana’s 1992 Constitution be upheld.
Amoakowaa’s claim is predicated on important constitutional clauses, particularly Articles 15 and 18(2), which safeguard an individual’s privacy and dignity.
Additionally, she cited Section 167 and the Sixth Schedule of the Public Health Act, 2012 (Act 851), which, under Ghanaian law, guarantee every patient the right to secrecy.
The complainant claims that in addition to being against the law, the hospital’s placement of surveillance equipment in private exam rooms has seriously upset her.
She talks about how a highly inappropriate and intrusive violation of trust caused her to suffer from psychological trauma and persistent anxiety.
Amoakowaa’s remedy requests seek the court to:
- Issue a declaration that the use of CCTV in breast examination and consultation rooms violates her constitutional rights and is legally impermissible;
- Order the hospital to dismantle and remove all such surveillance equipment from medical consultation spaces;
- Compel the destruction of any footage in which she appears and prohibit any further retention or use of such material;
- Award her general damages for the psychological and emotional harm suffered;
- Grant costs incurred in pursuing the legal action.
An affidavit outlining the specifics of the alleged infractions, their scope, and the legal foundation for each remedy requested bolsters her assertions.
Additionally, the application allows for any additional remedy that the court may decide is necessary.
