George Afriyie, a former vice president of the Ghana Football Association (GFA), has filed a notice of application for an injunction to prevent the association’s elections from taking place on October 5, 2023.
According to Joy Sports, this interlocutory injunction was obtained on Friday, September 29, 2023, from the Human Rights Division of the Accra High Court. It will be presented by Mr. Afriyie’s attorney on October 12, 2023.
The main argument in Mr. Afriyie’s application is that the Elections Committee’s decision to remove him from the running for president, along with the Appeals Committee’s earlier this month affirmation of this decision, constituted a “violation of fundamental human rights, particularly with regard to due process and fair hearing.”
Therefore, Mr. Afriyie is asking the court for a declaration that the decisions of these committees are “invalid due to the violation of the Plaintiff’s [George Afriyie] fundamental human rights.” Despite an ongoing appeal at the Court of Arbitration for Sport (CAS), he has also asked the court to find that the GFA president election is taking place in violation of his human rights, notably his right to “due process and/or fair hearing.”
In addition, an injunction is requested, preventing the defendant from choosing a president for its Executive Council until the outcome of Mr. Afriyie’s lawsuit or the conclusion of his appeal before the Court of Arbitration for Sport.
The Elections Committee determined that George Afriyie’s nomination form did not satisfy the criteria necessary for him to run for the top position in Ghanaian football, and as a result, George Afriyie was disqualified from the GFA presidential elections.
