Alfred Tuah Yeboah, the deputy attorney general, has declared his plan to request daily hearings in the case of Nana Appiah Mensah, commonly known as NAM 1.
NAM 1 is currently charged with 39 counts of fraud and money laundering, and the protracted legal proceedings have lasted for years. NAM 1 was the CEO of the now-defunct Menzgold Ghana Limited.
On Tuesday, September 19, 2023, Mr. Tuah Yeboah had a press conference in which he said that the pursuit of daily hearings intends to hasten the legal procedure and give closure to the victims of NAM 1’s alleged fraud.
“We are of the humble opinion that this is a matter that we must apply to the courts for an expedited hearing,” he said. “So, at the case management, we will put up that application and request to the court, subject to the court’s convenience, to have this matter heard on a daily basis.”
In the meanwhile, bail for Nana Appiah Mensah has been set at GH 500 million with the obligation of four sureties, none of whom must provide an explanation.
He is required to leave his passport at the court registry as part of one of the bail requirements.
This choice was made after Menzgold Ghana Limited, Brew Marketing Consult, and NAM 1 pleaded not guilty to 39 counts of fraud and money laundering allegations.
His attorney, Mr. Kwame Akuffo, asked the court to uphold the GHc5 million bail condition that had previously been approved at the circuit court where the case was initially heard before the state filed a nolle prosequi.
The motion for bail was not opposed by the Deputy Attorney. But he requested the court to take into account the significant sum of GHc1.68 billion at stake in the dispute.
The judge ultimately decided to issue bail in the amount of GHC 500 million and required four sureties without cause. In addition, as part of his bail conditions, Nana Appiah Mensah is required to go to the Criminal Investigations Department (CID) headquarters every Thursday.
