Lawyers for the former CEO of NAFCO threaten to take legal action against the AG for contempt over the airport arrest.

Hanan Abdul-Wahab’s lawyers have declared their intention to file a contempt lawsuit against the Attorney General, Deputy Attorney General, and Director of the Bureau of National Investigations (BNI). 

They allege that these individuals wilfully disobeyed a High Court order by arranging for their client to be arrested at the Accra International Airport, even though the court had authorised his travel.

Additionally, the legal team maintains that Abdul-Wahab’s bank accounts were not frozen by a legitimate court order at the time of the incident.

Godfred Yeboah Dame, Abdul-Wahab’s attorney, called the allegations made by Deputy Attorney-General Dr. Srem Sai in a Facebook post on July 4, 2026, which attempted to defend the arrest, “false” in a statement released on Sunday, June 4.

The lawyers claim that on June 29, the High Court in Accra, presided over by Justice Achibonga, a Court of Appeal judge sitting as an additional High Court judge, allowed Abdul-Wahab to travel to the United Kingdom from July 4 to July 12 for a medical visit with his optometrist.

According to the statement, the court approved the application after hearing arguments from the prosecution and defence, including Dr. Srem Sai. It further stated that the order was consistent with previous court rulings permitting accused individuals awaiting trial to travel for legitimate medical purposes.

Dame contended that a number of well-known defendants, including as Drs. Stephen Opuni, Seidu Agongo, Alhaji Collins Dauda, Cassiel Ato Forson, and Kwabena Duffuor, had previously received comparable travel authorisations while dealing with criminal charges.

The attorneys also denied claims that Abdul-Wahab tried to take money out of a Republic Bank account that was frozen prior to his departure.

“We challenge him to produce evidence of a withdrawal of any sum by our client from any of his bank accounts since the date of the court order,” the statement said.

Dame insisted that no legitimate freezing order was in effect.

The statement claims that any prior freezing orders expired on May 5, 2026, when the prosecution dropped earlier accusations against Abdul-Wahab, resulting in his release.

The statement also cited a decision made by the High Court in Adentan on May 20, 2026, about new charges that were submitted on May 15. According to the court, Abdul-Wahab’s re-arrest started “a fresh process,” suggesting that there was no freezing order in place.

Dame stated that the Executive Director of the Economic and Organised Crime Office (EOCO) had already received a written letter outlining the legal position around two weeks prior.

Based on claims they maintain are unfounded, the legal team accused the Attorney-General’s Office of deceiving the public and illegally using the BNI to detain Abdul-Wahab.

The Attorney-General, his deputy, and the Director of the BNI will face contempt charges, according to Dame, who described the airport arrest as a “blatant and wilful violation” of a High Court ruling.
