The New Patriotic Party’s (NPP) constituency executive elections have been halted by the High Court in Sefwi Wiawso, Western North Region, while the court considers a plea for an interlocutory injunction.
On Friday, July 10, 2026, the court presided over by His Lordship Justice Oliver Atsu Abadain issued the order in a lawsuit involving seven plaintiffs, important NPP officials, and local Electoral Commission (EC) representatives.
Ben Kumi, Peter Tanya Kyemalo, Samuel Asamoah, Solomon Adjei, Abena Ayensua, Emmanuel Owusu, and Joseph Boakye Danso are the plaintiffs in the case.
The National Chairman of the NPP, the Director of Information Technology for the party, the Chairman of the Constituency Election Committee, the Regional Chairman of the NPP, the Constituency Chairman, the Regional Director of the Electoral Commission in the Western North Region, and the District Director of the EC in Bibiani are among the defendants.
According to court records, the case was brought before the court after an earlier request to have an original suit dismissed on the grounds that the plaintiffs had not used all of the party’s internal conflict resolution procedures and that the action amounted to an abuse of the legal system.
On July 6, 2026, Benjamin Armah filed an affidavit in support of the earlier application; on July 9, 2026, the plaintiffs filed an affidavit in opposition.
During the hearings, Alfred Obeng Boateng, the attorney for the plaintiffs/respondents, and Dennis Kumah-Kwarkye, the attorney for the fourth defendant/applicant, made presentations to the court.
The application to strike out the lawsuit was rejected, according the court judgement.
In order to allow the case to be decided on its merits, the court then ordered that the fourth defendant be given time to submit an affidavit opposing the ongoing petition for interlocutory injunction.
Portions of the order included, “IT IS HEREBY ORDERED that having dismissed the motion seeking to strike out the suit, and seeing that the Constituency Executive Election is scheduled to be conducted between 10th to 15th July, 2026, the 4th Defendant is allowed time to file his affidavit in opposition to the motion on Notice for Interlocutory Injunction in order for him to be heard on the merit of the case on 17th July, 2026.”
In addition, the court ordered that the constituency executive elections not be held until the injunction application was decided.
The order further stated, “IT IS FURTHER ORDERED that in line with Order 1 rule 2 of CI47, NPP Constituency Executive Election shall be held until the determination of the pending injunction motion.”
The interlocutory injunction application is scheduled to be heard in court on July 17, 2026.
As the NPP continues to prepare to reorganise its constituency structures in advance of future national political activity, the development is expected to have an impact on the party’s ongoing internal electoral processes in some areas of the Western North Region.
