Thomas Andy Owusu, the second accused in the case of Republic v. Charles Bissue and Others, and the Office of the Special Prosecutor (OSP) are scheduled to present a plea deal to the Criminal Court tomorrow.
The Supreme Court has rendered a decision in the continuing civil lawsuit between Charles Bissue and the OSP, which is a related development.
Bissue challenged the OSP’s illegally issued arrest warrant for his arrest in 2023 in a Human Rights Court case.
The OSP refuted this, claiming that Bissue may be arrested without a warrant.
Bissue claimed that the warrant had been issued by the Kaneshie District Court, which acknowledged that it had not issued any such order. Additionally, the District Court’s attorney general testified that there was no warrant.
Bissue relied on an interview granted by the Special Prosecutor on Joy FM’s Newsfile show, as he was unable to produce the purported warrant.
His defense team contended that they thought a warrant had been issued because of the statements made during the interview.
After establishing that there was no warrant, the Human Rights Court dismissed the case, ruling that neither the interview nor Bissue’s attorney’s cross-examination was necessary.
Bissue filed a petition with the Supreme Court to reverse the verdict since he was unhappy with it.
In order to adequately evaluate the contents, the Supreme Court mandated that the Newsfile interview be played in court.
The case will now go back to the Human Rights Court, where the OSP will have the opportunity to question Bissue’s attorney about the warrant’s purported existence.
