Due to the anti-LGBTQ+ bill, a farmer in the Ashanti Region has filed a lawsuit against the Attorney General and Speaker of Parliament, Rt Hon Alban Sumana Kingsford Bagbin.
The Speaker and Attorney General violated provisions of Ghana’s 1992 constitution, according to private citizen Paul Boama Sefa, in how the parliamentary body handled the Human Rights and Family Values Bill, 2021.
The plaintiff claims in his writ that the august body violated the terms of section 100 (1) of the Public Financial Management Act, 2026 (Act 921) by failing to conduct a fiscal impact analysis of the anti-gay Bill considering its financial implications.
He adds that despite the bill having financial ramifications for the consolidated fund, a fiscal effect study report was not sent to parliament.
This similar argument regarding the absence of a fiscal effect analysis is made in the Attorney General’s memo to Parliament, which is cited in the lawsuit.
Among other things, he is asking for a court order to stop the speaker and his deputies from moving forward with the anti-LGBT+ bill’s proceedings until this is followed.
