The court reached a 5-2 majority decision and stated that the complete decision will be made public on Wednesday, November 13.
Following the decision, Attorney General Godfred Dame told reporters that he expects the Speaker of Parliament to follow the court’s decision.
The New Patriotic Party (NPP) parliamentary caucus leader, Alexander Afenyo-Markin, is noted for having filed a lawsuit to contest Speaker Bagbin’s announcement that four seats were open.
The main point of contention is Bagbin’s interpretation of the constitutional clause pertaining to the announcement of open seats in Parliament and what the House’s standing orders state when a member of parliament makes such a proclamation.
Alexander Afenyo Markin, the majority leader, was granted an exparte application by the Supreme Court.
Following that, the Speaker of Parliament filed a petition to have the exparte applications dismissed; the Supreme Court rejected this argument.
