Baffour Akoto Osei is prohibited from claiming to be the Omanhene of Kwahu by an interim injunction issued by the Eastern Region House of Chiefs (ERHC).
The ruling comes after a petition contesting the purported illegal destoolment of Daasebre Akuamoah Agyapong II by some kingmakers was submitted by Nana Kwaku Boateng, the Etena/Bretuo Abusuapanyin of Kubaase Abetifi.
Nana Kwaku Boateng claimed in his appeal that the destoolment was void because the kingmakers had not followed the proper procedures to remove Daasebre Akuamoah Agyapong II.
“The purported destoolment of Daasebre Akuamoah Agyapong II by some kingmakers without due process is unlawful,” he stated.
In its decision on January 19, 2025, the ERHC’s Judicial Committee issued the injunction to stop the kingmakers from interfering with Daasebre Akuamoah Agyapong II’s responsibilities at his Abene Palace.
The Committee stressed that in order to protect the Omanhene’s position and keep the Kwahu Traditional Council in order, the temporary injunction was required.
Following the purported destoolment in October 2024, Akyeamfour Asiedu Agyeman, the Abetifihene, took over as acting head of the Kwahu Traditional Council. In a similar incident, Daasebre Akuamoah Agyapong II obtained a restraining order against him. The Abetifihene’s activities, according to Daasebre Akuamoah Agyapong II, were illegal and threatened his power as Omanhene.
In court records, Daasebre Akuamoah Agyapong II declared, “The Abetifihene’s actions are unlawful and constitute a threat to my position as the Omanhene of Kwahu.”
He further maintained that the Abetifihene had no right to call Council meetings or designate himself acting president without his approval.
In its decision on February 28, 2025, the Koforidua High Court issued an injunction prohibiting Abetifihene from posing as acting president or calling any Council meetings without Daasebre Akuamoah Agyapong II’s consent.
The court stressed that in order to safeguard the Omanhene’s position and stop additional disturbances inside the Kwahu Traditional Council, the injunction was required.
With the courts intervening to preserve Daasebre Akuamoah Agyapong II’s legitimacy as Omanhene and Council president, the legal disputes highlight the growing tensions within the Kwahu Traditional Council.
In matters pertaining to traditional leadership, the rules seek to restore stability and guarantee that the correct procedures are followed.
