Rockson-Nelson Dafeamekpor, a member of parliament, has filed a lawsuit before the Supreme Court, asking for a number of rulings and clarifications on the President’s authority under the 1992 Constitution of Ghana.
The NDC MP is requesting a declaration that a President may only approve or disapprove a bill within seven days, unless the bill has been sent to the Council of State, in accordance with Article 106(1) and (7) of the Constitution.
Additionally, the attorney is requesting a ruling that the President cannot stop Parliament from forwarding a passed measure to him.
In addition to this, he is requesting a determination that a letter dated March 18, 2024, signed by the Secretary to the President, Nana Bediatuo Asante, and addressed to the Clerk of Parliament, is unconstitutional. He’s asking for an order telling the President to take this letter back.
In addition, he has requested that the court issue any further directives or orders that it may find necessary.
The president decided not to sign the measure until all outstanding cases before the highest court were resolved, which prompted the most recent legal action.
