Ghana’s Acting Rent Commissioner, Frederick Opoku, has warned landlords and property owners against demanding more than six months’ rent advance, stating that such practices violate the country’s Rent Act.

Speaking at a stakeholder engagement organised under the theme “Manifold Agenda With Landlords and Property Owners,” Mr. Opoku stressed that the Rent Control Department is committed to ensuring compliance with Ghana’s rent laws without fear or favour.

Ghana Rent Law: Six-Month Rent Advance Limit

Mr. Opoku explained that Section 25(5) of Ghana’s Rent Act prohibits landlords from demanding rent advance exceeding six months. He noted that many landlords and tenants remain unaware of their legal responsibilities, contributing to persistent violations of the law.

According to him, his 10 months in office have highlighted the need for increased public education and awareness of Ghana’s rent regulations and tenant rights.

He clarified that his engagement with landlords is primarily intended to educate stakeholders, understand their concerns and encourage cooperation rather than create unnecessary conflict between landlords and tenants.

Landlords Must Issue Rent Cards and Tenancy Agreements

The Acting Rent Commissioner also reminded landlords of their obligations under Section 20 of the Rent Act, which requires them to issue rent cards to tenants.

He warned that failure to comply with the law could attract legal consequences, including possible imprisonment, as provided for under the applicable legislation.

Mr. Opoku further expressed concern about landlords who collect rent payments without providing proper tenancy documentation, emphasising the importance of transparency and accountability in rental transactions.

Rent Control Department Vows Strict Enforcement

Mr. Opoku maintained that the Rent Control Department would not compromise on enforcing Ghana’s rent laws. He insisted that the era of overlooking violations must come to an end and urged landlords to familiarise themselves with the legal requirements governing rental properties.

He also thanked President John Dramani Mahama for giving him the mandate to improve efficiency within the department.

The commissioner’s remarks highlight the importance of understanding Ghana rent advance laws, landlord responsibilities, tenant protection and rent payment regulations to prevent disputes and promote fairness in the housing sector.
