The decision of the Commission for the Control of INTERPOL’s Files on the Red Notice issued at Ghana’s request for Mr. Kenneth Nana Yaw Ofori-Atta has been forwarded to the Office of the Special Prosecutor (OSP).
Citing contextual factors at the time of issuance, such as “polarised political statements from members of current and former administrations about the conduct of the investigation,” as well as public controversy surrounding prosecutorial and extradition processes, including public acknowledgement by senior officials at the Ministry of Justice of an inability, at the time, to pursue extradition due to the early procedural stage of the case, the Commission ordered the notice to be deleted in accordance with INTERPOL’s rules on political neutrality and notice processing.
Additionally, it noted that after Mr. Ofori-Atta was arrested in the United States on January 6, 2026, his location was known, cooperation with U.S. authorities was ongoing, and extradition procedures had already been started, negating the need for the notice.
He must appear in the United States to answer to several criminal accusations after being summoned by the Criminal Division of the High Court in Accra.
His appearance is still being arranged through the proper legal and diplomatic processes.
The OSP restates its commitment to due process and the fair, legal, and unbiased prosecution of corruption and corruption-related acts, and that it will continue to be guided only by the law and the available evidence.
