Bernard Mornah, the Peoples National Convention’s (PNC) presidential candidate, has filed a lawsuit against the Electoral Commission (EC) alleging that they disqualified him from running in the 2024 race.
Mornah was one of the eleven rejected candidates for president.
The EC clarified that the candidates for president were not allowed to run in the elections scheduled for December 7, 2024, since they neglected to make the necessary corrections on their nomination papers.
Jean Mensa, the chair of the EC, clarified, saying, “Mr Bernard Mornah also had incomplete details of supporters. He also used registered voters in a particular district to support the nomination in other districts. His form also contained varying signatures for the same supporters and in some cases the same signature for different supporters. The committee was of the view that he be disqualified.”
Mornah, nevertheless, argues that his disqualification was unlawful.
Tuesday, September 20, 24: Mr. Mornah filed an application at the Accra High Court requesting a number of reliefs, including an order prohibiting the EC from starting any Presidential election-related activities until he is deemed a “duly nominated candidate and allowed to contest the elections.”
Once more, he is requesting an order of certiorari that would overturn the EC’s decision to bar him from running for president in the 2024 election, as well as an order of mandamus that would require Jean Mensa, the chairperson of the EC, to certify him as an eligible candidate for the elections.
In addition, he is asking the court to declare that the EC violated both his fundamental constitutional rights and Article 23 of the 1992 Constitution by acting in an arbitrary, unjust, and capricious manner during the disqualification process.
