The Accra High Court has ordered the Attorney-General’s Department to take over all criminal proceedings that are presently being handled by the Office of the Special Prosecutor (OSP) right once, pending formal approval from the Attorney-General.
The decision casts doubt on a number of prominent corruption cases that are now pending in the courts, such as the trial of former Finance Minister Ken Ofori-Atta and the NPA extortion case involving former CEO Mustapha Abdul-Hamid.
The order comes after a live constitutional challenge to the validity of the OSP’s independent prosecutorial powers under Article 88 of the 1992 Constitution was heard by the Supreme Court.
The OSP and the AG’s Department have not yet responded.
