Investigative journalist Anas Aremeyaw Anas filed an application with the Supreme Court to overturn a ruling made by a High Court that dismissed his lawsuit for defamation against Kennedy Ohene-Agyapong, the Member of Parliament for Assin Central.
The application was denied.
A five-member panel of the supreme court led by Chief Justice Gertrude Sackey Torkornoo dismissed the certiorari case, which sought an order to overturn the High Court’s ruling, by a vote of 3-2.
Justices Issifu Omoro Tanko Amadu and Emmanuel Yonny Kulendi dissented, while Chief Justice Henrietta Mensa-Bonsu and Justice Samuel Asiedu supported the majority.
The court stated that the complete justification for its ruling will be available at the registry by March 4 of this year, but it did not provide it.
On March 15, 2023, the claim was dismissed by the Accra High Court. The lawsuit was dismissed for lack of merit by the Court, which was presided over by Justice Eric Baah, a Court of Appeal judge sitting with extra responsibilities as a High Court judge.
He went on to say that while the statements made against Anas were true and defamatory, he was unable to substantiate them.
