Dr. Cassiel Ato Forson, a former deputy minister of finance, and businessman Richard Jakpa have both been cleared and released by the Court of Appeal.
A three-judge panel rendered the result by a majority vote of 2-1.
The panel determined that the March 30, 2023, ruling of Justice Afia Serwah Asare-Botwe, which obliged the defendants to begin their defense, was incorrect.
The appeal for acquittal was granted by Justices Kweku Tawiah Ackaah-Boafo and Philip Bright Mensah, but it was denied by the presiding judge, Justice Poku Acheampong.
Following the Court of Appeal’s ruling, Richard Jakpa and Dr. Ato Forson are now free.
Between 2014 and 2016, the state was allegedly defrauded of €2.37 million in a deal involving the purchase of 200 ambulances by Cassiel Ato Forson and Richard Jakpa, a spokesman for Big Sea.
