The conviction of former Microfinance and Small Loans Center (MASLOC) Chief Executive Officer Sedina Christine Tamakloe Attionu was overturned by the Court of Appeal due to a number of legal and evidentiary flaws in the prosecution’s case.
The court found that the trial judge improperly shifted the burden of proof onto the accused and relied on evidence that did not meet the necessary legal standard.
The three-member panel of Justices Emmanuel Ankamah, Emmanuel Senyo Amedahe, and Samuel Obeng-Diawuo issued a comprehensive 94-page unanimous ruling on Thursday, July 30, holding that the prosecution had not proven the offences beyond a reasonable doubt and that several of the convictions could not be upheld in court.
As a result, the High Court’s convictions and 10-year prison sentence were overturned by the appellate court, which also cleared Tamakloe of all charges.
The Attorney-General’s preliminary objection that Tamakloe could not use the Court of Appeal’s jurisdiction because she had fled during her trial was one of the court’s initial concerns.
