With immediate effect, President John Dramani Mahama has ordered a thorough examination of the agreement between KGL Technology Limited and the National Lottery Authority (NLA).
In a letter to the Minister of Minister, Dr. Callistus Mahama, the Executive Secretary to the President, stated that renegotiation is necessary to guarantee full protection of the public interest, value for money, and strict adherence to relevant laws, regulations, and government policy.
“I refer to the various publications by The Fourth Estate and to the preliminary consultations held with the Attorney-General and Minister for Justice, as well as the Minister for Finance, on matters arising from the contract between the National Lottery Authority (NLA) and KGL Technology Limited,” it stated.
The investigation, according to the statement, would examine the contract’s legal foundation, scope, duration, and financial conditions, as well as assess revenue-sharing arrangements, fees, commissions, exclusivity provisions, and any contingent liabilities to the state.
It is responsible for ensuring compliance with the Constitution, the Public Procurement Act, the National Lottery Act, and any other applicable approvals, as well as assessing performance obligations, transparency requirements, data ownership, and audit rights.
It stated that the assessment would identify any decrees that would unfairly favour the State or impede regulatory supervision.
It was highlighted that, pending the resolution of this process, all parties must fully cooperate with the review team and offer unrestricted access to contracts, addenda, communications, financial records, and operational data as needed.
It stated that a combined technical team will be formed by the Attorney-General, the Minister for Finance, and the Minister in charge of the National Lottery Authority to carry out this process and provide recommendations to the President within a given time limit.
The team was instructed to make sure that the revised terms secure better fiscal returns to the State, strengthen governance and accountability, maintain regulatory authority, and align the arrangement with government policy and best international practice in cases where the review establishes grounds for renegotiation.
“Kindly take note of this directive and ensure strict compliance. Please accept the assurances of my highest consideration,” the letter said.
